TERMS OF SERVICE

1. SERVICE DESCRIPTION

NestAI is operated by chirai.dev and provides private AI server deployment for teams. By using NestAI, you agree to these terms. The Service provisions dedicated cloud servers on your behalf via Hetzner Cloud, running Open WebUI and Ollama.

2. ACCOUNT RESPONSIBILITY

You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information during registration. One account per person or organisation. You may not share login credentials.

3. PAYMENT TERMS

Subscriptions are billed monthly in USD/INR via our payment processor. We accept major credit and debit cards, and regional payment methods including UPI and net banking for Indian customers. Subscriptions auto-renew until cancelled. You may cancel anytime from your dashboard. No refunds are provided for partial billing periods unless required by applicable law.

4. DATA & PRIVACY

Your AI conversations and documents are stored exclusively on the dedicated server we provision for you. NestAI does not access, read, or transmit your AI conversation data. We store only billing metadata, account information, and server provisioning details.

5. SERVER USAGE

You may not use your NestAI server for illegal activities, to generate harmful content, to send spam, or to violate any applicable law. We reserve the right to suspend accounts that violate these terms. Server resources are for your team only and may not be resold.

6. SERVICE AVAILABILITY

We target 99% uptime for our infrastructure. We are not liable for downtime of third-party services including Hetzner Cloud or Supabase. Scheduled maintenance will be communicated in advance where possible.

7. CANCELLATION & DELETION

When you cancel, your server remains active until the end of the paid period. After expiry, your server and all data on it are permanently deleted. We recommend exporting your Open WebUI data before cancellation.

8. LIMITATION OF LIABILITY

NestAI and chirai.dev are not liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the three months preceding the claim.

9. CHANGES TO TERMS

We may update these terms with 14 days notice via email. Continued use after changes constitutes acceptance. If you disagree, you may cancel before changes take effect.
